Burnham Guides, LLC: Assumption of Risk and Release of Liability -  "Release"
 

I do for myself, ourselves, my, our heirs, executors, administrators and assigns voluntarily and with full knowledge, assume all risk of accident, injury and illness to my person and property which may arise from, or be related to, in any manner, my preparation for, and participation in kayaking, stand-up paddleboarding, biking, fishing, hiking, camping and other outdoor-related activities (hereinafter "Activities") with BURNHAM GUIDES LLC.


I, desiring to join BURNHAM GUIDES LLC in such Activities, do hereby declare that I fully understand and accept the following facts of life when participating in water and outdoor activities:
1) Paddling or any outdoor-related activity in which I engage may expose me to various safety hazards and risk of injury;
2) I understand that exposure to elements of wind, sun, heat, rain, cold, storms, lightning, as well as tidal currents, rip tides, open water, surf, wildlife, sea life, insect bites, and other natural conditions can result in serious injury or death;
3) I also understand that I am willingly exposing myself to unpredictable hazards to my personal safety and health that are inherent with activities such as paddling, biking, fishing, hiking, camping, campfires, dining outdoors, and walking on uneven surfaces.
4) I further acknowledge that my participation in the Activities is completely voluntary and I accept all responsibility for my health and well being during the Activities.

With this understanding, I hereby release BURNHAM GUIDES LLC, their agents and employees from all claims, demands, actions, causes of action, and all liability for damages, losses or injuries (personal and property), and attorney's fees and costs, that may arise from my preparation for, and participation in the Activities with BURNHAM GUIDES.

In addition, I understand that I am not obligated to enter into this release agreement and have the right and free will not to participate in Activities with BURNHAM GUIDES.  I also agree that the laws of Virginia shall govern any and all disputes that may arise from my preparation or participation in the above Activities.

 

READ AND INITIAL EQUIPMENT WAIVER: I agree to be responsible for loss or damage as follows:

Sea Kayak full loss: $1500 ~ Recreational kayak full loss: $600 ~ SUP full loss: $600 ~ Bike full loss: $150 ~ Paddle: $120 ~ PFD: $60 ~ SUP fin: $25 ~ Bilge pump: $25 ~ Hatch cover: $100 ~ Rudder: $100

Cost to repair equipment damage to be determined by Burnham Guides.
