Snorkel Tour Liability Waiver

I understand that there are inherent risks involved with snorkeling and boating including but not limited to equipment failure, perils at sea, acts of other participants, adverse weather conditions and I hereby assume such risks.

I understand that I have a duty to exercise reasonable care for my own safety and I agree to do so. I assert that I am physically fit to ride on a boat and will not hold Divers Den or 2407137 Ontario Inc. or their employees, agents or other associated personnel responsible. I hereby agree to freely, voluntary and expressly assume and accept all risks of any injury to any part of this users body while snorkeling.

I hereby forever release this dive shop from and indemnify it and hold it harmless for any and all responsibility or legal liability for any injuries or damages to any user or any equipment whether or not such injuries or damages are caused by the negligence of this dive shop. I agree not to make a claim against or sue this Dive Shop for any injuries or damages relating to snorkeling and/or the use of this equipment and I will accept full responsibility for those injuries or damages.

I have carefully read this agreement. I am aware that this is a binding contact which provides a comprehensive release of liability. However, it is not intended to assert any claims or defenses that are prohibited by law.

This document constitutes the final and entire agreement between the dive shop and the undersigned.

The Dive Shop, owners and crew of the charter vessels shall not be liable for any loss or injury howsoever caused, whether by reason of fault or negligence of the owners or otherwise.

I understand and agree that if I am renting equipment and it is damaged beyond normal wear and tear or lost I may be subject to a replacement or repair fee.
