General Release and Agreement

In consideration of my participation with Candice Ensign,and “Journey with Equus”, their animals and their affiliates, for a personal/professional Coaching, consultation, seminars or workshops or volunteer work.
I hereby generally release, waive, discharge and hold harmless Candice Ensign and “Journey with Equus”, their animals, their agents, employees, assistants, independent contractors andcosponsors and their affiliates, of any liability whatsoever related to myparticipation with the “Journey with Equus” event, for a personal /professional Coaching, consultation, coaching session, seminar or workshop or to learn their training methods as well as any of their affiliates. I execute this release with the express intention of effecting any legal consequences provided by Colorado Civil Code, that is, the release of all liability associated with participating with Candice Ensign, “Journey with Equus”, activities, programs, and events. This letter of agreement shall constitute the full and complete understanding between the parties and shall supersede any prior orcontemporaneous representations or agreements, oral or written. This agreement shall be interpreted pursuant to and governed by the laws of the State of Colorado. If any action at law or equity is brought to enforce any of the terms of this agreement, the prevailing party shall be entitled to actual attorney's fees and costs. It is agreed that the venue for any such action at law is the County of Elbert, Colorado. No assignment of this agreement is permitted and any attempt to assign all or any rights, obligations or duties granted under this agreement shall be null and void.

I hereby completely release Candice Ensign, and “Journey with Equus”, their animals and their agents, employees, assistants, independent contractors and cosponsors and their affiliates, of any liability whatsoever related to my participation with this event on this or any other day.

"A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known to him must have materially affected his settlement with the debtor."

“Journey with Equus” seeks and strives for safety at all times. However, I understand that there are certain risks inherent in equine related activities. I acknowledge that all activities involving horses (included but not limited to: horseback riding, handling, leading, groundwork and other contact) involve this degree of risk.

Under Colorado law, an equine professional is not liable for any injury or death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to Section 13-21-119, Colorado Revised Statutes. In consideration of the services of “Journey with Equus”, their agents, owners, officers, volunteers, participants and all other persons or entities acting in any capacity on their behalf (herein collectively referred to as “Journey with Equus”), I agree to waive and release forever all claims for damages against “Journey with Equus” for any and all injuries and/or losses that could be sustained while participating in “Journey with Equus”'s program. I further understand that I am not covered by “Journey with Equus”’s insurance policy.

I acknowledge that I have been given the opportunity to ask questions regarding any aspect of the release contained herein, and by signing below, I do acknowledge that I have carefully and completely read and fully understand all aspects of the release and agree to these terms in their entirety. I hereby agree that should any legal proceeding arise relating to this general release and agreement, the dis allowance of any term or condition will not prevent the legal enforcement of all other terms and conditions of said agreement. Having been so apprised, I hereby elect to and do assume all of the risk for claims heretofore or hereafter arising known or unknown, from this release and from my participation.

Client/participant is aware that photos may be taken during your visit or at an event & used for private promotion of Candice Ensign and Journey with Equus's website & events and authorizes their use accordingly.
