Standards of hygiene, accommodation, and transport in some countries where product tours take place are often lower than comparable standards than what the client may reasonably expect in their home country or region. The Tour Company at all times endeavors to appoint reputable and competent local suppliers and to comply with all applicable laws and regulations concerning health and safety in the regions where product tours operate. At all times the decision of the Tour Company, its authorized agents, its local operators and/or subcontractors Tour Leaders or other designated representative will be final on all matters regarding the safety and well being of the clients and operational requirements of the product tour. By traveling with the Tour Company, the client agrees to abide by the authority of the tour leader or designated representative. The client must at all times strictly comply with all applicable laws and regulations of all countries and regions visited on the applicable product tour. If the client is affected by any condition, medical or otherwise, that might affect client’s ability to travel or participate in adventure travel activities, client’s enjoyment of the product tour being booked, the ability to travel or enjoyment of any other clients on the product tour, or the treatment to be administered to the client in any emergency situation, the client must advise the Tour Company at the time of booking and complete a medical form provided by the Tour Company, along with any other documents reasonably requested by the Tour Company to ensure the health and safety of all clients who travel with the Tour Company.

Customer, client and or guests acknowledge that the "service" being provided is that of customer service, tourism and concierge services. The guest acknowledges that all and any confidential pricing and privileged customer service and concierge email, chat, phone and all other communications are considered to be part of the "service". By requesting and or booking an activity the client understands that the service provided takes place at a certain point in time and cannot be reversed. This includes time spent by our booking platforms, systems and with concierge representatives in the performance of their assigned duties. The services provided include but are not limited to communication with guests, arrangement of tours and activities, preparation of directions, preparation of details and instructions, checking on availability, sending of emails and other forms of electronic communication, messaging providers and local suppliers, confirming tours, transport and activities, communication with tour and activity providers and/or any other time based service related to the preparation and organization of the guest activities. The client understands and agrees that by requesting and engaging in the Tour Company customer service the client's understanding of that service is considered as having been provided.

Credit Card payments are final. Client agrees not to initiate any type of credit card dispute or chargeback. Open disputes shall be retracted and closed immediately in favor of the Tour Company and/or its agents and representatives. The client acknowledges that if a credit card dispute or chargeback is opened: the client, cardholder and issuing bank will be held responsible for any fees and penalties related to the recovery of the charged back funds. These fees can include actual time spent, court fees, legal costs, collection fees, interest payments on the full amount, travel expenses, meals and accommodation necessary to dispute the chargeback, penalties and fines and all and any other costs associated with defending against and disputing the chargeback.

Disputing your own credit card charges: Chargeback fraud, also known as “friendly fraud,” happens when a consumer makes an online purchase with their credit card or other payment method and then calls the card issuer and requests a refund, citing fraud. The bank refunds the money and the consumer keeps the service provided, leaving the tour company on the hook for the cash. In some cases, the cardholder forgets which charges they made and in some, they intentionally are committing fraud. Before you head down this road, make sure the charge wasn’t yours. It’s hard to remember every little transaction and some retailer transactions look unfamiliar on statements. For example, third-party payment systems, like Trekksoft, use either their name, the merchant’s name or a combination of both. One of these is an honest mistake; the other is outright fraud. If you are intentionally committing chargeback fraud, it ends up costing retailers $21.8 billion a year, which will eventually get passed down to consumers. And it’s 100 percent illegal — you are exposing yourself to a host of consequences.

All reports, files and other documents prepared and submitted by client and /or Tour Company shall be complete and shall be carefully checked by the person identified as the client as project manager and key personnel attached hereto, prior to submission to the Tour Company. Client agrees that the Tour Company’s review is discretionary and client shall not assume that the Tour Company will discover errors and/or omissions. If the Tour Company discovers any errors or omissions prior to approving the client's reports, files and other written documents, the reports, files or documents will be returned to the client for correction. Should the Tour Company or others discover errors or omissions in the reports, files or other written documents submitted by the client after the Tour Company’s approval thereof, the Tour Company’s approval of client’s reports, files or documents shall not be used as a defense by client in any action between the Tour Company and client, and the reports, files or documents will be returned to client for correction.
