Release and Hold Harmless Agreement for Equestrian Activities


WHEREAS, the UNDERSIGNED acknowledges the inherent risks involved in riding and/or working around horses, which risks include but limited to bodily injury from using, riding or being in close proximity to horse, among other risks, and further, that both horse and rider can be injured in normal use or in competition, schooling, lessons or trail ride lessons. Signed into law In Senate on January 6th, 2017 New York State has statute that states Owners and Operators, such as Bridle Hill Farm, LLC, of Agricultural Tourism areas shall not be liable for any injury to or death of a visitor. And visitors (any student/customer/visitor) to Agricultural Tourism arenas have the responsibility to exercise reasonable care regarding the disclosed risks of the Agricultural Tourism activity;


IN CONSIDERATION, therefore, for the privilege of riding and/or working, around horses at Bridle Hill Farm, LLC, the UNDERSIGNED does hereby agree to hold harmless and indemnify Bridle Hill Farm, LLC, and further release them from any liability or responsibility for accident, damage, injury, or illness to the UNDERSIGNED or any horse owned by the UNDERSIGNED or to the family member or spectator(s) accompanying the UNDERSIGNED on the premises of Bridle Hill Farm, LLC.


UNDERSIGNED understands and agrees to abide by all Terms and Conditions, and Barn Safety Rules as posted and outlined on the Bridle Hill Farm, LLC website www.bridlehillfarm.com. And, UNDERSIGNED shall always wear appropriate boots or riding shoes with low heels while mounted and/or working around horses. Everyone regardless of age must always wear an approved riding helmet while mounted. Bridle Hill Farm, LLC will provide an approved riding helmet if UNDERSIGNED does not have one. Undersigned acknowledges reading the clearly posted State of New York 1152--A Cal. No. 425 Agricultural Tourism memorandum.


Bridle Hill Farm, LLC shall photograph and/or video/audio tape students/customers involved in equestrian activities and barn/events that maybe held on Bridle Hill Farm, LLC premises. Bridle Hill Farm, LLC shall also photograph and/or video/audio tape students/customers involved in equestrian activities and barn/events that are held on other farm premises. UNDERSIGNED understands and consents upon providing its signature below granting Bridle Hill Farm, LLC permission to use likeness in a photograph, video, or other digital media in any and all its publications, including web-based publications, without payment or other consideration. Bridle Hill Farm, LLC strictly prohibits carrying any cell phones, cameras, and any other items that may be a distraction while riding as a safety concern or possible loss of any items. Bridle Hill Farm, LLC shall not take any responsibility for lost items.


I further understand that in order to promote the safety of visitors and livestock, as well as the security for Bridle Hill Farm. Bridle Hill Farm may conduct video/audio surveillance of any portion of its premises at any time, the only exception being private areas of restrooms, showers, and dressing rooms, and that video/audio cameras will be positioned in appropriate places within and around buildings and used in order to help promote the safety and security of people and property. I hereby give my consent to such video surveillance at any time Bridle Hill Farm may choose.

BRIDLE HILL FARM, LLC services must be prepaid on credit card (accepted contract) at time of scheduled, and the Smart Waiver Release and Hold Harmless Electronic Paperwork must be completed prior to arrival to farm.

Riding helmets shall be outside for easy access.

Undersigned must await mounting demonstration and Undersigned must be able to mount their horse, on their own with provided mounting block, once demonstration is provided.

Small group Private Trail Rides shall be with one family only.

Any Undersigned that does not follow the above instructions outlining safety requirements and rules will forfeit the trail ride, forfeit any refund or credit, and will be asked to leave the property immediately.


UNDERSIGNED AGREES IT HAS READ THE ABOVE PARAGRAGHS, POSTED NEW YORK STATE LAW AND ACKNOWLEDGES SUCH UPON PROVIDING ITS SIGNATURE BELOW.
