RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

The undersigned have employed the services of Teton Valley Lodge, Inc., to participate in fly fishing and other activities associated with fly fishing, including wading, drifting, and floating. In consideration of being permitted to participate in these activities assisted by Teton Valley Lodge, Inc., and its owners, guides, employees, and representatives, each of the undersigned:

1. Recognizes and acknowledges his/her awareness that there are inherent risks, dangers, and hazards associated with fly fishing and other activities associated with fly fishing, including personal injury, death, property damage, and property loss.

2. Freely and willingly accepts and assumes all such risks, dangers, and hazards and the possibility of personal injury, death, property damage, and property loss.

3. Waives any and all present or future claims against Teton Valley Lodge, Inc., and its owners, guides, employees, and representatives (collectively Releasees) and releases the Releasees from all liability to the undersigned for any and all loss or damage on account of injury to the undersigneds person or property caused while fly fishing or participating in associated activities.

4. Agrees to indemnify Releasees from any and all liability for property damage or personal injury to any third party resulting from my participation in fly fishing and other associated activities.

5. Agrees that this Agreement shall be effective and binding upon the heirs, next of kin, executors, administrators, assigns, and representatives of the undersigned in the event of death or incapacity of the undersigned.

6. Agrees that any litigation involving the parties to this Agreement shall be brought solely within the state of Idaho and governed by the laws of the state of Idaho.

If the undersigned is a guardian of the minor children (under 18 years of age) listed below, the undersigned signs this on behalf of the minor children.

I confirm that I have read and understand this Agreement prior to signing it, and am aware that by signing this agreement I am waiving certain legal rights which I or my heirs, next of kin, executors, administrators, assigns, and representatives may have against the Releasees.
