Sport of Rock Climbing Release/Indemnification of all Claims and Covenant Not to Sue

NOTICE: THIS IS A LEGALLY BINDING AGREEMENT. By signing this agreement, you give up your right to bring a court action to recover compensation or obtain any other remedy for any injury to yourself, to your minor child/ward or to your property or for your death or that of your minor child/ward, however caused, arising out of your (or your child/ward’s) participation in the Sport of Rock Climbing, now or any time in the future.

Acknowledgement of Risk

I HEREBY ACKNOWLEDGE AND AGREE that rock climbing, participating in any climbing classes and/or training and the use of any climbing walls or equipment (collectively, the “Sport of Rock Climbing”) has inherent risks including serious and permanent injury and death. I have full knowledge of the nature and extent of all the risks associated with my (or my child/ward’s) participation in the Sport of Rock Climbing, including but not limited to:

  • All manner of injury, including serious injury and death, may result from, but are not limited to: falling, mechanical failure of the equipment, equipment breaking, my (or my child/ward’s) loss of balance or control; variable and difficult climbing conditions; collision with the walls, the floor, climbing holds, or exposed or hidden structural supports or beams, rope abrasion or entanglement; injuries resulting from falling/fallen climbers or falling/fallen objects; failure of ropes, slings, climbing holds, anchor points, or any part of the climbing wall; collision with other equipment or structures; collision with other persons; illness or trauma; the proximity of medical care which may or may not be readily available; the failure to act safely or within one’s own ability or to stay within designated areas; negligence of other climbers and/or other persons; and negligence on the part of you or your child/ward.
  • All manner of potential injuries or medical disorders arising from or relating to the Sport of Rock Climbing such as heart attack, stroke, death, heat stress, sprains, strains, broken bones, head injuries, torn muscles, tendons, ligaments among others; accidental injuries (including those caused by me (or my child/ward), those caused by another person and those of a slip and fall nature) occurring anywhere near the proximity of any climbing walls.
  • I understand that wearing a helmet and the use of safety harnesses, mats, ropes and other safety and climbing equipment (collectively, “Safety Equipment”) does not eliminate the dangers associated with the Sport of Rock Climbing, but that in certain instances the use of Safety Equipment can reduce the risk of permanent injury or death. I understand that the YMCA recommends that I (or my child/ward) use the Safety Equipment at all times and that if I (or my child/ward) chose to not use any Safety Equipment at any time that I (or my child/ward) do so against their advice and at my own risk.

I freely accept and fully assume all such risks and the possibility of my (or my child/ward’s) personal injury, death, property damage and loss resulting from my (or my child/ward’s) participation in the Sport of Rock Climbing. I further acknowledge that the above list is not inclusive of all possible risks associated with the participation in the Sport of Rock Climbing and that the above list in no way limits the extent or reach of this release and covenant not to sue.

Release/indemnification and Covenant Not to Sue

In consideration of my (or my child/ward’s) participation in the Sport of Rock Climbing, I, the undersigned, agree to release and on behalf of myself (or my child/ward), and my (or my child/ward’s) heirs, representatives, executors, administrators, and assigns, HEREBY DO RELEASE the Young Men’s Christian Association of Metropolitan Washington (the “YMCA”), its officers, agents, and employees, Vertical Rock Development Corp, Vertical Rock Inc, and Vertical Rock Outdoor School LLC (collectively, the “YMCA Parties”) from any cause of action, claim, or demand of any nature whatsoever, including but not limited to, a claim of NEGLIGENCE, which I (or my child/ward), and my (or my child/ward’s) heirs, representatives, executors, administrators and assigns may now have, or have in the future against the YMCA Parties on account of personal injury, property damage, death or accident of any kind, arising out of or in any way related to my (or my child/ward’s) participation in the Sport of Rock Climbing whether that use is supervised or unsupervised, however the injury or damage is caused, including, but not limited to the NEGLIGENCE of the YMCA Parties.

In consideration of my (or my child/ward’s) participation in the Sport of Rock Climbing, I, the undersigned, agree to INDEMNIFY AND HOLD HARMLESS the YMCA Parties from any and all causes of action, claims, demands, losses, or costs of any nature whatever arising out of or in any way related to my (or my child/ward’s) participation in the Sport of Rock Climbing.

I hereby certify that I have full knowledge of the nature and extent of the risks inherent in my (or my child/ward’s) participation in the Sport of Rock Climbing and that I am voluntarily assuming the risks. I understand that I will be solely responsible for any loss or damage, including death, I sustain (or my child/ward sustains) while participating in the Sport of Rock Climbing and that by this agreement the YMCA Parties are relieved of any and all liability for such loss, damage, or death.

I further certify that I am (or my child/ward is) in good health and that I have (or my child/ward has) no physical limitations which would preclude my (or my child/ward’s) safe participation in the Sport of Rock Climbing.

I further agree, AND HEREBY WAIVE, ANY RIGHT TO A JURY TRIAL IN MATTERS ARISING OUT OF OR IN ANY WAY CONNECTED TO THIS AGREEMENT OR THE CONSTRUCTION, INTERPRETATION, OR VALIDITY THEREOF. I acknowledge and agree that this provision is a specific and material aspect of this agreement.

By signing this agreement, I acknowledge that I have carefully read and understand the Acknowledgement of Risks and the Release/Indemnification and Covenant Not to Sue and I assume all risks, including but not limited to the risk of bodily injury, death or property damage, both known and unknown, and I assume full responsibility for my (or my child/ward’s) participation in the Sport of Rock Climbing.

I acknowledge that this agreement shall be governed by, and construed in accordance with, the laws of the District of Columbia, except to the extent preempted by federal law, and shall be binding upon, inure to the benefit of, and be enforceable by, the parties hereto and their respective successors, assigns, heirs, agents and representatives.

I agree to read and fully abide by all the posted rules and any rules that are otherwise communicated to me by a staff member. I agree to comply with the requests and instructions of all YMCA personnel and to request more explanation from a staff member in the event that I do not fully understand the rules or instructions as they may relate to the Sport of Rock Climbing.

I agree that should any portion, or portions, of this agreement be found or declared unenforceable or void by any court or competent tribunal for any reason, the remaining portions shall be severable, and fully enforceable, as if no such finding of un-enforceability had been issued.

I further certify my date of birth and my present age, and that I am therefore of lawful age (18 years or older) and otherwise legally competent to sign this agreement. I further understand that the terms of this agreement are legally binding and certify that I am signing this agreement, after have carefully read it, of my own free will.

Contract to Follow Sport of Rock Climbing Safety Policies

I, accept full responsibility for my own safety (and that of my minor child/ward) and the safety of other climbers while in the climbing gym area. I agree to abide by, and to help enforce, the following Sport of Rock Climbing Safety Policies: [initials]

  • All climbers must be certified by a YMCA rock wall staff member before top rope belaying.
  • No unbelayed climbing above the bouldering line.
  • Climbers should not carry any items not related to the Sport of Rock Climbing while climbing to reduce the risk of falling items.
  • Climbers must be roped and belayed through a belay plate.
  • Belayers must be anchored.
  • Roped climbers and belayers must wear harnesses and helmets.
  • Crash mats must be used at all times.
  • Lead climbers must use adequate protection to eliminate the possibility of a ground fall at all times.
  • Inform other climbers of any situation seen as unsafe or not in accordance with Sport of Rock Climbing Safety Policies.
  • All climbers are asked to assist and encourage less experienced climbers.
  • Climbers should not consume any alcohol or other substance which would impair their sense of judgment while or prior to participating in the Sport of Rock Climbing.
  • Promptly report any equipment defects, unsafe situations or accidents that I become aware of.

The YMCA reserves the right to withdraw the membership and/or guest privileges of any individual permanently or for a specified period of time for breach of contract in following the Sport of Rock Climbing Safety Policies, or for any conduct that is viewed as unsafe or inappropriate.

In consideration of my (or my child/wards) participation in the Sport of Rock Climbing, I acknowledge that I have read and agree to abide by the Sport of Rock Climbing Safety Policies.
