1. In consideration of being allowed to enter or use the facilities, including but not limited to the shooting ranges, and participate in the activities of Sportsmans Elite, LLC located at 4520 Doniphan Drive, El Paso, TX 79922, I hereby agree to each of the following terms and conditions of this Agreement, and I have initialed each page as having been read and understood by me: a.I have read the The Range Rules, a copy of which has been given to me by Sportsmans Elite. I understand these Range Rules may be amended from time to time and that I am responsible for reviewing the posted Range Rules when I use The Range Facilities. I verify that, before using the Facilities, I either have watched or will watch The Range safety presentation. I agree to obey and comply with the Range Rules, general policies and rules of operation and administration of Sportsmans Elite. 2.I am familiar with and understand the operation of each firearm (rifle, handgun, shotgun, or machine gun) which I will use at The Range. The word operation includes the safe handling, loading and unloading procedures, and safety mechanisms and features of each firearm.
3. I understand that SPE requires the use of newly manufactured commercial ammunition at all times in SPE. I accept full and complete responsibility for the inherent risks resulting from my and anyone elses use of reloads or hand loads, including all responsibility for personal injuries to myself and anyone else. I also agree to thoroughly check to be sure I am using the correct ammunition at all times.
4. I agree that prior to participating in or observing any shooting activities, I will inspect the Facilities, firearms and ammunition to be used and, if I believe anything is unsafe for any reason, I will so advise a Range Officer and will leave the unsafe portion of the Facilities immediately.
5.I acknowledge and fully understand that I and all others engaged in shooting, coaching, observing or training with firearms at SPE will be engaged in activities that involve substantial inherent risks of serious personal injury including disability or death and severe social and economic losses which might result from my actions or inactions or the actions or inactions of others; such risks include but are not limited to: a. My failure to abide by firearms safety rules or to properly handle or use firearms or ammunition.
b. The inability of The Range personnel (including Range Officers) to, at all times, monitor or supervise The Range members, their guests, hourly fee users and others using The Range Facilities including said ranges and shoot house.
c. The failure of others to abide by firearms safety rules or to properly handle or use firearms or ammunition;
d. The characteristics, including the design, manufacturing or other defects, of any firearm or ammunition being used by myself or others at Sportsmans Elite.
e. The characteristics, including the design, construction, and maintenance, of Sportsmans Elite 6.I recognize that I may be expelled from the Facilities for violation of the Range Rules or for behavior deemed unsafe by The Range personnel. Decisions regarding expulsion are final.
7.I accept full responsibility for any damage or destruction I cause to The Range property, whether accidental, negligent, willful or otherwise. The Range property includes, but is not limited to, the facility, range equipment, target frames, target supports or mechanisms, firearms, signs, and all equipment, electrical and otherwise. The Range reserves the right to recover from me a reasonable charge for any such damage and is entitled to recover its costs, including reasonable attorneys fees, incurred in bringing any claim for such damage.
8.On behalf of myself, my heirs, executors, administrators and assigns, I hereby assume all risk of personal injury and accept personal responsibility for any and all damages that may occur as a result of any such personal injury, disability or death. The word damages includes, but is not limited to, the incurring of physical and emotional injury of any kind, loss of physical function, ability or capacity, medical expenses, lost wages or income, loss of consortium and any other compensatory damage.
9.On behalf of myself, my heirs, executors, administrators and assigns, I hereby waive, release and discharge Sportsmans Elite, LLC and their affiliates, and their Officers, directors, owners (members), managers, employees, agents, successors and assigns (Released Parties) from any and all claims, demands, actions or lawsuits seeking damages on account of any personal injury, disability or death occurring to myself or anyone else, caused in whole or in part or alleged to be so caused by the negligence of any of the Released Parties or caused by anyone else.
10.On behalf of myself, my heirs, executors, administrators and assigns, I hereby agree to indemnify and defend the Released Parties from any and all claims, demands, actions or lawsuits for any personal injury,
11.Disability or death occurring to myself or any other person which result entirely or in part from the actions, failure to act, or negligence of myself, my guests or minors for whom I am responsible.
12. I agree that this Adult Release, Assumption of Risk and Indemnity Agreement shall be interpreted according to Texas law and that any dispute shall he resolved in Texas.
13. Membership in The Range will be available to persons who are legally able to possess a firearm. The Range Members must be in compliance with all federal, state and local laws concerning ownership and handling of firearms. Membership will be granted, and may be revoked, at the sole discretion of The Range.
14. I certify as follows: (1) that I am not and have never been the subject of a criminal or any other proceeding that prevents me from legally owning, handling or possessing firearms under SPE or Federal law; (2) that I can lawfully own, handle and possess a firearm; and, (3) that all information given in this Application is true and correct to the best of my knowledge.
15. In the event I bring a minor to SPE, the attached guardians release, assumption of risk and indemnity agreement has been signed by the minors legal guardian. I recognize the safety of everyone at The Range is my responsibility and I agree not to cause harm to myself or others at The Range. Warning: We recomend avoiding low cut shirts or open toe shoes. This will decrease the chance of accidental burns due to hot spent brass. I hereby state that I, the actual signer of this Agreement, am an adult over the age of 18 years, that I have read and understood each of the above terms and conditions, that I understand everything set forth above and that I have knowingly given up substantial legal rights by signing below, which I do voluntarily. SMILE! I understand that an image is being taken as I sign my liability release. Only applies if signing in at Kiosk at a Sportsman's Elite location. This does not apply to those signing waivers on personal devices. The Range Rules The strictest discipline must be maintained at all times at Sportsmans Elite Shooting Range in order to maintain a safe environment. By signing below, you indicate that you read, understand and will obey the following safety rules: 1.Eye and ear protection is MANDATORY at all times.
2.No steel core ammo or re-loaded ammo.
3. Never use alcohol, drugs, or other mind-altering substances before or during your range session.
4. Firearms brought into the range shall be cased or holstered until forward of the black ready line (painted on the floor behind the assigned shooting stall).
5. All guns that are benched should be unloaded, action open, and magazine removed.
6. Know and understand how your firearm works and understand operation of all safety features.
7. Be certain that your ammunition is correct for the firearm you will be shooting.
8. Do not load the firearm until ready to fire.
9. Keep any firearm pointed downrange at ALL times, perpendicular to the target line, whether loaded, unloaded, or malfunctioning. Be sure of the target and what is behind the target.
10. Keep your finger off the trigger and on a fixed point on the side of the frame until you are on target and ready to fire.
11. No uncontrolled rapid fire at any time.
12. Should a misfire or other malfunction occur, keep the firearm pointed downrange and signal the range master. Place the firearm on the shelf, pointed downrange, and obtain assistance. Do not leave the firing line with a loaded or jammed firearm.
13. Accidental discharges, damages or injuries must be reported to the range master immediately, no matter how minor they may seem.
14. Under no circumstances may a loaded firearm be passed to another person. A firearm will be considered loaded if a magazine is inserted and/or firearm is in a closed, locked condition.
15. At the command Cease Fire! immediately make your firearm safe, set the gun down pointed downrange, and step away from the firing line into the safety area with nothing in your hands.
16. No food, drink, or tobacco use of any kind is permitted on the range, even in range bags, purses etc.
17. Advise range personnel of any medical condition which could create a safety issue for you or others.
18. Collection of brass that falls on shooters side of the firing line is permitted when your session is over under no circumstances may any implement or appendage cross forward of the red firing line.
19. No drawing from holsters without prior permission from on-duty Range Officer.
20. Only one shooter in the shooters box in a lane at a time. All other participants must be behind the safety line.
21. Range Officers decisions and determinations are final. Any misuse of facility or disregard of rules will result in expulsion from the range.
22. Firing at anything other than approved targets will result in revocation of range use permit and range privileges and liability for damages. Failure to report an errant round striking the facilities may result in loss of range privileges. Be sure of your target.
23. Never move forward of the firing lane. If anything falls forward of the firing line, contact the range master for assistance.
