CUGA Waiver - Minor

CONSENT FROM THE PARENTS AND OTHER COMMITMENTS PERSONALLY AND ON BEHALF OF THE MINOR

Assumption of Risks

I hereby declare that I am duly authorized to act for and on behalf of the Minor(s) so that he/she may take part in one or several of the activities sanctioned by the Canadian Underwater Games Association (CUGA), according to the terms and conditions of this document.

I am aware of the nature of the activities which are being proposed by the Canadian Underwater Games Association (CUGA), which involve certain dangerous conditions. I am aware of the nature of the activity or activities which are being proposed as well as the experience of the Minor and I am convinced that he/she has the competence and skill to participate therein.

I therefore acknowledge and accept that in taking part in the activities, the Minor(s) exposes himself/herself to risks of serious injuries or even death.

I hereby declare having properly informed the Minor(s) of all the risks indicated hereinabove and of any other risk which I may be aware of. In the event I deem that said risks are too high for him/her, I will pull him/her out of the activity.

I declare that I am fully aware of those serious risks and dangers and I agree, notwithstanding said knowledge, to allow the Minor(s) to have access to the site and/or participate in any of the events sanctioned by the Canadian Underwater Games Association (CUGA).


CUGA Code Of Conduct 

CUGA is committed to advancing a sports environment and culture that is respectful, inclusive, and supportive of club and player development. All participants can expect to play, practice, compete, and interact in a safe environment.

I acknowledge and accept the terms and conditions of the Code of Conduct, and as a member of CUGA, will abide by them.  


Waiver of Recourse for Property Damage

For and on behalf of the Minor(s), I hereby waive any recourse for property damage that the Minor(s) may sustain during his/her presence on the site or his/her participation in one or several of the events of Canadian Underwater Games Association (CUGA), regardless of whether said property damages are caused by an accident, through the fault or negligence of a third party or the Club. The present waiver inures to the benefit of Canadian Underwater Games Association, its executive, directors, volunteers, members, as well as the promoters, participants, track operators, event and facility operators and owners, officials, rescue personnel, sponsors, or any other person or organization having participated in the production of the activity, its setting up or its promotion.

Should the Minor(s) institute a recourse against the aforementioned beneficiaries notwithstanding this waiver, I will hold the latter harmless from any condemnation which may be pronounced against them in capital, interest and costs, and I will reimburse the attorneys fees required to ensure their defense of said recourse.
