Membership Contract, Notices, Disclosures, & Agreement: NOTICE: Any holder of this consumer contract is subject to all claims and defenses which the debtor could assert against the seller of goods or services obtained pursuant hereto or with the proceeds hereof recovery hereunder by the debtor shall not exceed amounts paid by the debtor hereunder. Memberships are non-transferable and non-refundable, under any cirecumstances. If a membership is cancelled by Calibers National Shooter Sports Centers, LLC or any of its subsidiaries due to a member(s) breach of contract, a pro rated refund will be issued. Read contract before signing. Purchase should ensure receipt of an extra copy of this agreement. Buyer & member warrant, represent and agree that member(s) of this application is/are in good physical and emotional condition; and that member(s) has/have no disability, impairment, or ailment preventing member(s) from engaging in active use of Calibers National Shooters Sports Centers, LLC or any of its subsidiaries indoor shooting facilities, or that would make it detrimental or inimical to the member(s) health, safety, comfort, or physical condition if member(s) does/do use Calibers National Shooters Sports Centers, LLC or any of its subsidiaries facilities. All member(s) also affirm that they may legally posses and use firearms for recreational purposes in accordance with statutes of both the State of New Mexico and the United States of America. Member(s) agrees by the use of facilities and/or by attendance at facilities owned/leased by Calibers National Shooters Sports Centers, LLC or any subsidiaries, that the member(s) expressly agrees that Calibers National Shooters Sports Centers, LLC or any subsidiaries thereof shall not be liable for any damages arising from personal injury sustained by the member(s) or guest(s), in, on, or about the premises, or as a result of their using the facilities and equipment therein. By execution of this agreement, member(s) assume(s) full responsibility for any injuries, damages or losses which may occur in, on, or about the premises and does hereby fully and forever release and discharge Calibers National Shooters Sports Centers, LLC and/or any subsidiaries owners, employees, and agents from any and all claims, demands, damages, rights of action, or cause of action, present or future, whether be known or unknown, anticipated or unanticipated, resulting from or arising out of the member(s) or guest(s) use or intended use of Calibers National Shooters Sports Centers, LLC and subsidiaries facilities and equipment thereof. Lost or stolen articles: Calibers National Shooters Sports Centers, LLC and/or any subsidiaries are not responsible for lost, damaged, or stolen articles/belongings whatsoever. This contract shall be interpreted in accordance with the statutes of the State of New Mexico and if any particular provision in this contract were deemed invalid, the same shall not affect the balance of this contract of the remaining provision thereof. I apply for membership to Calibers National Shooters Sports Centers, LLC and/or any subsidiaries. I agree that I and all persons authorized to us the facilities under this membership shall abide, at all times, to the rules and policies of Calibers National Shooters Sports Centers, LLC and/or any subsidiaries. I also agree that my membership will be terminated if my conduct can be in any way construed as detrimental to the good name, safety, or best intrest of Calibers National Shooters Sports Centers, LLC and/or any subsidiaries, its members or guest. Members and their guest assume all danger and risk of loss, injury, or damage incidental to the discharge of firearms and weapons on the use of the grounds of a Calibers National Shooters Sports Centers, LLC and/or any subsidiaries facilities, whether such shall be caused by the passive or active negligence of Calibers National Shooters Sports Centers, LLC and/or any subsidiaries owners, employees, and agents any and all claims or injuries which arise out of or are connected with the use of Calibers National Shooters Sports Centers, LLC and/or any subsidiaries facilities. I have read and understand this agreement and acknowledge that my digital signature is representative of this understanding. Range Rules 1. Shooters and patrons must follow the directions of calibers personnel at all times. 2. Anyone under the influence of alcohol or debilitating drugs will not be allowed to shoot and will be required to immediately vacate the premises. 3. Shooters must be at least 8 years old. Minors under the age of 18 must be accompanied and supervised by a paying legal guardian at all times. 4. Eye and ear protection must be on before entering the airlock and remain on at all times while on the range. 5. When entering and exiting the range, please be sure that only one door to the range is open at a time. 6. All firearms must remain in their case until they are at the firing line. Firearms must also be in a case while being transported between shooting lanes. 7. Firearms that are not in use must be unloaded, in a case or on the bench and muzzles must remain pointed down range at all times. 8. Keep your finger off of the trigger until your sights are on your target. 9. Rifles must be fired from the shoulder and when not in use, stored on the floor with the muzzle pointed down range. 10. Be sure your gun and ammunition are compatible. 11. Always bench a safe firearm: Revolvers with cylinders open; Semi-autos with magazine out and slide locked back. 12. Do not directly hand firearms to another person. Set the unloaded firearm on the bench wit the muzzle point downrange and let the other person pick it up and load it. 13. Shooters will be held financially responsible for any damage caused to the range or range equipment. 14. If a firearm malfunctions, and you are not comfortable clearing the malfunction, ask a Range Officer for assistance. 15. Emergency cease fire: When down range lights are turned off, all shooters must unload their firearms, place them on the bench and step back from the firing line. Types Of Firearms And Ammunition That Are Permitted For Use All modern cartridge type pistol, rifle, and shotgun calibers, up to and including .50 BMG, are permitted on the range. Shotgun Ammunition is limited to #4 or bigger Legally owned NFA devices (silencers, machine guns, etc...) are permitted. Calibers reserves the right to inspect proof of registration. Antique ignition (muzzleloading / black powder) firearms are NOT permitted. Specialty ammunition is NOT permitted. This includes but is not limited to: steel core, armor piercing, tracer,incendiary, and paint. Non-paper targets are NOT permitted. NOTICE: Due to lead and high decibal level exposure using our facilities during pregnancy may be harmful to your babys health and/or cause pregnancy complications. NOTICE: Participant and/or guardian of particpant(s), represent and agree that the individual(s) completing this waiver is/are in good physical and emotional condition; and that the participant(s) has/have no disability, impairment or ailment preventing the participant(s) from engaing in active use of the indoor shooting range facilites provided by Calibers, LLC and subsequent entities. Participant(s) agree the individual(s) completing this waiver have no condition that may be detrimental or inimical to the health, safety, comfort or physical contdition of other participants using said facilities. All participants alo affirm they may legally posses and use firearms for the recreational purposes in accordance with the statutes of both the State of New Mexico and the United States of America. Participant(s) agrees by the use of the facilities and/or by attendance at any facilities associated with or owned by Calibers, LLC, agree that Calibers, LLC and subsequent entites shall not be liable for any damages arising from personal injury, sustained by the participant(s) or guest(s) in, on or about the premises, or as a result of using the facilites and equipment therein. By execution of this waiver, participant(s) and/or guardian(s) of said participant(s) assume all danger and risk of loss, injury, and/or damages, upto and including possible catostophic injuries related to participating in said activies.
