Mt. Bike Contract of Release and Indemnification

Please read carefully! This is a release of liability and waiver of certain legal rights.

In this Release Agreement, the term “Skibowl” shall include Mt. Hood Ski Bowl, LLC, dba Mt. Hood Skibowl, Hurricane Racing, and any Special Event sponsor, organizer, or promoter, and their respective employees, agents, officers, directors, affiliates and representatives, as well as all officials, workers, volunteers, sponsors, promoters, and advertisers. “Mountain Biking” shall include all activities, events, services or use of facilities provided, arranged, organized, sponsored or conducted by Skibowl, including, but not limited to: cycling; mountain biking; use of mountain scooters and dirt boards; use of chairlifts and uphill conveyances; bike descents; use of the mountain bike paths and trails; use of the Free Ride Park; use of the Skills Park; bicycle skills training; use of trails and roads; guided mountain biking activities; race competitions; demonstrations and events; orientation and instructional courses and sessions; downhill and “mass stage downhill” events; and all other related activities, events or services. “Special Events” shall refer to any and all activities provided, arranged, organized, conducted or sponsored by Skibowl, including, but not limited to, races, competitions, demonstrations, training, and other such events or activities.

I understand that injuries are a common and expected part of Mountain Biking. I understand that Mountain Biking at Skibowl takes place on steep and rugged terrain and features that are both physically and technically challenging and will expose the rider to many risks, dangers and hazards. These include, but are not limited to: use of chairlifts and uphill conveyances; changing weather conditions; failure of equipment; falls; loss of balance; high speed descents; difficulty or inability to control one’s speed and direction; rapid or uncontrolled acceleration on hills and inclines; extreme variation in terrain including steep or slippery sections, trees, roots, tree stumps, logs, cliffs, rocks, rock drops, loose gravel, holes, depressions, streams and creeks, constructed features such as bridges, ramps, walls, ladders, bumps, gap jumps, berms, jumps, elevated trails and drops; collisions with natural and man-made objects, other mountain bikers, vehicles, pedestrians, photographers, spectators and officials; encounters with domestic and wild animals; loss of visibility; blind spots; the competitive nature of Special Events; negligence of other mountain bikers or users of the premises; and bicycles falling from chairlifts.

I understand that Mountain Biking and Special Events are voluntary activities. I understand that if I do not wish to sign this Release Agreement, there are many places that I may engage in the sport of mountain biking where no release agreement is required. I understand that if I choose to engage in Mountain Biking at Skibowl, that I may do so without using the chairlifts and uphill conveyances and that I may do so without using the Free Ride Park or similar facilities. I understand that while Mountain Biking I am the sole person who determines my speed and course and my ability to perform any maneuver or aspect of Mountain Biking.

I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH MOUNTAIN BIKING AND SPECIAL EVENTS AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.

IN CONSIDERATION FOR MY PARTICIPATION IN MOUNTAIN BIKING, SPECIAL EVENTS, AND/OR MY USE OF ANY SERVICES, EQUIPMENT, PREMISES AND FACILITIES AT SKIBOWL, I HEREBY AGREE TO RELEASE, HOLD HARMLESS AND INDEMNIFY SKIBOWL FROM ANY AND ALL CLAIMS I MAY HAVE FOR ORDINARY NEGLIGENCE AGAINST SKIBOWL ARISING DIRECTLY OR INDIRECTLY OUT OF MY PARTICIPATION IN MOUNTAIN BIKING, SPECIAL EVENTS, AND/OR MY USE OF ANY SERVICES, EQUIPMENT, PREMISES AND FACILITIES AT SKIBOWL.

I understand that ANSI or SNELL-approved helmets are required. I agree to wear my helmet at all times. I understand helmets are for rent at Hurricane Racing. I understand that helmets are not designed to prevent all types of head injuries.

I agree to abide by Oregon State Law, the Mountain Biker’s Responsibility Code, and all signs, notices, warnings, and closures, and I understand that violators may be prosecuted or have their use privileges revoked without refund. I agree to follow all instructions and rules in connection with any Special Events and understand that my failure to do so will result in disqualification from the event and possible trespass from Skibowl’s premises. I agree it is my sole responsibility to be familiar with all laws, rules, instructions, notices, signs, warnings, closures and other information related to Mountain Biking and Special Events.

I hereby irrevocably grant and convey to Skibowl all right, title and interest in and to record my name, image, voice, statements and/or writings including any and all photographic images and video or audio recordings at Skibowl. I further irrevocably grant to Skibowl, its advertisers, customers, agents, successors and assigns, unrestricted rights to use the above mentioned sound, still or moving images in any medium, including posting on the internet and word wide web, for educational, promotional, advertising, or other purposes without limitation consistent with the mission of Skibowl. I agree that all intellectual property rights to the sound, still or moving images belong to Skibowl. I voluntarily waive the right to inspect or approve such images and waive my right to any royalties, proceeds or other benefits derived from such photographs or recordings.

Permission to contact and use e-mail address and text: I accept and give permission to Skibowl and their subsidiaries permission to contact me about future offers, using the contact information I have provided. You may on occasion receive e-mail and text from Skibowl or subsidiaries, but will have the option to opt out of receiving further communications at any time by requesting to be placed on Skibowl or subsidiaries do not contact list. Skibowl and subsidiaries includes “all of the entities you will market from”.

This Release Agreement and any rights, duties, and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the State of Oregon. Any litigation involving the parties to this Release Agreement shall be brought in Circuit Court, Clackamas County, Oregon.

I confirm that I have carefully read and understood this agreement and all of its terms and all posted health and safety requirements. I also agree to indemnify (including costs and attorney's fees) Skibowl for any claim brought on behalf of a minor named in this agreement. I enter into this agreement freely and voluntarily and agree that it will be binding upon me, my heirs, next of kin, assigns, and legal representatives in the event of my death or incapacity.
