Northwest Ninja Park Minor Waiver

 

            I represent that I am the parent or legal guardian of the minor child named below (the “Participant”), who is voluntarily participating with my consent in one or more fitness classes, open gym sessions, and/or other fitness-related activities (collectively, “Fitness Activities”) offered by Northwest Ninja Park, LLC, an Oregon limited liability company (the “Company”).

 

            I represent that the Participant is in good health and that I, on behalf of the Participant, assume all risks connected with the Participant’s participation in the Company’s Fitness Activities.  I understand that the Participant’s participation in any exercise or fitness activity is inherently risky. I agree to disclose to the Company any condition or physical limitation, disability, ailment, or impairment that may affect the Participant’s ability to participate in any of the Company’s Fitness Activities. 

 

             In consideration for allowing the Participant to participate in the Company’s Fitness Activities, I, on behalf of the Participant, hereby release and indemnify the Company and its members, managers, agents, representatives, and employees from and against all actions, claims, demands, losses, expenses, and attorneys’ fees for any property damage, personal injury, or death the Participant may suffer in connection with participation in the Company’s Fitness Activities (except to the extent caused by the Company’s intentional misconduct).  This waiver and release is intended to be binding on myself, the Participant, the Participant’s heirs and other members of the Participant’s immediate family, and the personal representative of the Participant’s estate.  I have carefully read and understand the terms of this waiver and release, and I am signing it freely and voluntarily on behalf of the Participant.
