Jet Ski & Water Sports Liability Release Form 

I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH JET SKI & WATER SPORTS RECREATIONAL ACTIVITES, including but not limited to  equipment failure, perils of the sea, acts of other participants., and adverse sea and weather conditions, and I HEREBY ASSUME-SUCH-RISKS. 

 I understand that I am responsible for all physical damage to equipment billed at $200 per inch. Also responsible for water intrusion to engine billed at $1000 

I UNDERSTAND THAT I HAVE THE DUTY TO EXERCISE REASONABLE CARE FOR MY OWN SAFETY AND I AGREE TO DO SO. 

I assert that I am physically and mentally fit to ride on a Jet Ski and/or participate in Water Sports Recreational Activities and I will not hold ON THE BEACH, INC. or their employees agents or other associated personnel responsible if I am injured as a result of AWproblems (medical, accidental, or otherwise) which occur while chartering the equipment or otherwise participating on the trip.

I fully understand that ON THE BEACH, INC. has limited medical facilities and that in the event of illness or injury, appropriate care must be summoned by radio and treatment will be delayed until I can be transported to a proper medical facility I agree in advance to these conditions. 

     ON THE BEACH, INC., have made no representations to me, implied or otherwise, that they or their Employees can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid, I would like assistance and will not hold ON THE BEACH, INC. or their employees responsible for their actions in attempting the performance or rescue of first aid. 

I agree to forever discharge and release ON THE BEACH, INC. its Employees and Agents and Affiliates, from any and all responsibility or liabilit for any and all injuries to myself, to others and damages to the property belonging to ON THE BEACH, INC. 

I agree NOT to make a claim against or sue any of the above parties for injuries. I further specifically agree, on behalf &myself, and my heirs, to indemnify and hold harmless the released parties for any and all causes of action arising as a consequence of any incidents which might occur during my participation in any activities with or involving the released parties. 

I HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY IT, FROM THE DATE OF MY bIGNATURE, FOREVER INTO THE FUTURE. 

RELEASE OF LIABILITY

I agree to INDEMNIFY, RELEASE OF LIABILITY and HOLD HARMLESS ON THE BEACH, INC. and I AGREE to ASSUME ALL RISK IN CONNECTION with this WATERSPORTS ACTIVITY FOR I AM PHYSICALLY FIT TO PARTICIPATE.

(By signing, you are agreeing to and accepting all of the terms and conditions setforth in the Waiver and Liability Release Agreement)

ACKNOWLEDGEMENT 

I, hereby. acknowledge and agree I am purchasing/renting recreational products/services/activities/vessels/vehicles from On the Beach, Inc. and not the Wyndham Royal Vista Resort not the Royal Vista Owners Association, Inc, not Wyndham-Vacation Management, Inc. parent companies, subsidiaries or affiliates.  I also hereby acknowledge and agree that On the Beach, Inc. is an independent corporation and has no affiliation, joint venture relationship or any other business relationship with the Wyndham Royal Vista Resort, the Royal Vista Owners Association, Inc., Wyndham Vacation Management, Inc. nor any of Wyndham Vacation Management Inc.'s parent companies, subsidiaries or affiliates. 

By my signature below, I hereby warrant and represent, for and on behalf of myself that neither the Wyndham Royal Vista Resort, the Royal Vista Owners Association, Inc., Wyndham Vacation Management, Inc. nor any of Wyndham Vacation Management. Inc.'s parent companies, subsidiaries or affiliates have any, ownership, control or management rights over On the Beach, Inc. or any of On the Beach, Inc.'s products, services, activities, vessels or vehicles. I further understand and agree neither the Wyndham Royal Vista Resort, the Royal Vista Owners Association, Inc., Wyndham Vacation Management Inc. nor have any of Wyndham Vacation Management, Inc.'s parent companies, subsidiaries or affiliates endorsed On the Beach, inc. I hereby represent that I am at least eighteen (18) years of age and, if applicable, that I am the legal guardian on behalf of the Person whom I am signing, I have fully read and understand the terms of this Acknowledgement, and I am executing the same voluntarily and of my own accord.
