Om Sunshine Yoga & SUP Liability Waiver

I agree…

1. That I am 18 years of age or older and that I am physically, emotionally and mentally able to participate in Stand Up Paddleboarding, Yoga and Surfing Activities (paddling, standing, balancing on board, yoga poses etc).

2. That I acknowledge, accept and am aware that there are inherent and significant risks (“Risks”) associated with the participation in Stand Up Paddleboarding Activities. I recognize some of the hazards of Stand Up Paddleboarding Activities are wind, collision with other boats, waves, drowning, hypothermia, damage to personal belongings due to water contact, and changing weather conditions. I recognize that there is, at all times, a risk of capsize.

3. That although Om Sunshine Yoga & SUP has taken steps to reduce the Risks and increase safety of the Stand Up Paddleboarding Activities, it is not possible for Om Sunshine Yoga & SUP  to make the Stand Up Paddleboarding Activities completely safe. I freely accept and fully assume all responsibility for all Risks and release all claims I may have against Om Sunshine Yoga & SUP , and agree not to sue Om Sunshine Yoga & SUP  for any personal injury, death, property damage or loss sustained by myself or anyone in my group as a result of our participation in the activities due to any cause.

4. To hold Om Sunshine Yoga & SUP , harmless against any and all damages and claims against them however rising or occasioned, whether to property or to persons, including myself, anyone in my party and any third party.

5. That all participants will keep personal flotation devices on their paddleboards at all times.

6. That I am qualified and competent to operate and navigate the Stand Up Paddleboard and will operate it in a careful and prudent manner at all times during the term of this agreement.

7.To return the Stand Up Paddleboard and equipment in as good condition as when rented, excepting ordinary wear and tear and to pay for any and all loss of or damage to the Stand Up Paddleboard and to pay for any and all expenses incurred in repairing any such damage, replacing any such loss, and if necessary obtaining the return of the Stand Up Paddleboards or other property, as well as any revenues as a result of such damage or loss.

8.That I take full responsibility for my Stand Up Paddleboard and all equipment rented by me and people on my Stand Up Paddleboard and that all members on my Stand Up Paddleboard are made aware of this waiver and the risks associated with this activity.

9.To follow the directions of Om Sunshine Yoga & SUP  staff.

10.I have had sufficient time to read and understand each term in this waiver in its entirety and have agreed to the terms freely and voluntarily. I understand that this waiver is binding on myself and my Legal Representatives.
