I desire to participate in an activity at Gwinnett Swim. In consideration of my participation, I certify that I am in good health and have no physical or other impediment which would endanger me while participating in these activities and that I have been released and authorized by my doctor to participate in the activities. I acknowledge and agree that these activities have inherent risks. I have full knowledge of the nature and extent of all the risks associated with these activities that include serious injury and death. I understand and acknowledge that there is no designated lifeguard on duty, and I am swimming at my own risk. I knowingly and freely assume all such risks. In consideration of my participation in these activities, I hereby (on behalf of myself, my legal representatives, parents, heirs, executors, and administrators) release and forever discharge Gwinnett Swim, including its officers, directors, volunteers, employees, agents etc., and the Member Teams (and their respective officers, directors, agents, employees and volunteers) from and relinquish and forever waive any and all claims and causes of action arising out of my participation in the league for negligence, gross negligence, and such other actionable conduct resulting in personal or bodily injury, property damage or death. I will observe and follow all rules posted related to any activity I am participating in. Should any swim instruction/lessons be occuring during the time I am at the facility, I will not, nor attempt to engage, distract or video, the instructor(s), student(s), family member(s) or any staff, equipment and/or facility structures. I will not, in any manner, attempt to replicate lessons inside or outside of the facility. Tuition, Fees & Registration - Tuition and fees will be withdrawn upon enrollment, the first day of attendance, or on the first of the month, whichever precedes, from the ACH or Credit Card account you provide. The initial payment includes any enrollment fees, registration fees, and/or miscellaneous fees associated with the initial signup/enrollment process.
- Tuition is based on enrollment, not attendance.
- The registration fees and tuition fees are non-refundable and non-transferable.
ASI/ASI FasTrack Session Changes/Cancellation
- Registration Fees and First Month's Tuition are NON REFUNDABLE.
- Beginning 8/15/2023: Session changes for ASI and ASI FasTrack classes will be permitted, pending schedule availability, up to 14 days prior to the session/class start date. Tuition and registration fees may be transferred to a new session up to 14 days prior to the session start date.
- Session transfers will not be permitted within 14 days of the session/class start date. If the student should choose to forfeit their class within 14 days of the session/class start date, the student's registration fee and first month's tuition will be forfeited and is non-transferrable. New registration fees will be applicable upon re-enrollment and student(s) will not be eligible for membership.
- *If a medical situation should warrant deferring the session/class start date, a physician's statement must be provided.
- If a student should attempt to defer or forfeit classes after the session/class has started, the student will forfeit their registration fee and first month's tuitions. The student is ineligible for future membership.
Insufficient Class Enrollment/Cancellation If any class has insufficient enrollment, Gwinnett Swim reserves the right to offer another comparable class which may require the swimmer to change days/times, or to offer the class with an adjusted tuition rate, length of time and/or number of class meetings. Pool Contamination - All swimmers under the age of 4 years must wear 2 layers of protection. Approved reusable, washable swim diaper and a Happy Nappy diaper. Plastic pants are not acceptable. No exceptions. We have both diapers available to purchase at the facility.
- If your swimmer has a fecal accident in the pool, and is not correctly double diapered, a $250 decontamination fee will be posted to your account as we will need to close the pool for decontamination and cancel other students' classes.
- If your swimmer vomits food, a contamination fee will be accessed to your account. The first occasion will result in a $50 fine, the 2nd will result in a $150 fine, the 3rd will result in a $250 fine. These fines are assessed due to decontamination of the pool and possible delay and/or cancelLations of other students' classes.
Swimmer Illness - No swimmers should attend classes when sick (i.e., fever, nausea, vomiting, diarrhea, conjunctivitis, COVID-19 symptoms, etc).
- Gwinnett Swim reserves the right to dismiss a swimmer from a scheduled class if the student arrives at that class exhibiting possible symptoms of illness.
Instructor/Coach Illness - In the event of an instructor/coach absence, Gwinnett Swim reserves the right to provide an equally qualified instructor/coach for the scheduled class or schedule a timely makeup session for classes missed.
- Gwinnett Swim reserves the right to replace any current instructor/coach with another equally qualified instructor/coach.
Children (Students/Siblings/Guests) - All children under the age of 12 must be accompanied by an adult, not in the water.
- Parent(s)/guardian(s) must stay in the building or parking lot during lessons and be poolside at the end of lessons to attend to your child.
Changing Rooms and Personal Belongings - Changing rooms are provided for your convenience.
- Children 6 years and older must use their gender-specific changing room.
- Adults accompanying children 6 years and younger in the changing/locker rooms must use the gender appropriate room for the parent.
- UNDER NO CIRCUMSTANCES should an adult use the changing/locker room of the opposite gender. A family changing room is provided for this purpose.
- Due to limited space, strollers must be left outside of the changing rooms. We recommend parking your stroller when you first arrive, and bringing the necessary items to the changing room in a bag.
- Hooks/cubbies are available for use; locks are not provided.
- Gwinnett Swim is not responsible for any lost or stolen articles. You may visit the Reception Desk to check for lost belongings, or check the Lost & Found bins located in the waiting area.
Pool Deck Rules - Food and beverages are not permitted within the pool facility.
- Glass is not permitted anywhere in the building. No exceptions.
- Photography/videography is not permitted anywhere in the pool area. No exceptions.
Inclement Weather/Pool Closures - Although Gwinnett Swim makes every effort not to close, if closure is warranted due to inclement weather or pool related maintenance or otherwise, Gwinnett Swim will offer makeup classes.
- Please opt in for text messaging in your parent portal, as this is the primary means of quick communication for weather/incident related closures.
Holiday/MISC Closures - Please see the Gwinnett Swim Calendar in your parent portal for Holiday Closures. You will be notified in advance of any exceptions.
Media Release - Any photographs, audio or videos of students or families at Gwinnett Swim facilities and/or events may be used in promotional publications, websites or press releases.
- I acknowledge and agree that photographs and/or video may be taken of me while I am involved in the Activities or at the facility. I hereby grant Gwinnett Swim, it's legal representatives, successors and assigns, the irrevocable and unrestricted right (a) to use said minor's likeness in any manner and medium and to publish photographs and/or video images of said minor for editorial trade, advertising, commercial, and any other business purpose including, but not limited to, as evidence in litigation, and (b) to edit, alter, copy, copyright, exhibit or distribute the same without restriction. I hereby waive the right to inspect or approve the finished product containing my likeness and waive any right to payment or other compensation arising from the use of my likeness. I hereby release the Released Parties from all claims and liability relating to any photos or videos.
- If you wish to DECLINE the photo/video release, PLEASE COMPLETE THE NO PHOTO/VIDEO FORM AT THE RECEPTION DESK to be filled with your student's record.
- There is no compensation for the release.
Policy Changes Gwinnett Swim reserves the right to change policies, fees, or waivers at any time. At any time, without notice, owner(s), manager(s), or employee(s) reserve the right to revoke my membership/right to participate in activities at Gwinnett Swim. Should I violate any of the above rules/stipulations, I will be asked to leave the facility/grounds immediately, and will not be permitted reentry. Legalese I hereby agree to: (1) Release and forever discharge Gwinnett Swim, its agents, servants, employees, independent contractors, officers, directors, trustees, owners and all other persons or entities acting on its behalf; together with the owner(s) and/or lessor(s) of the Premises and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf (collectively, the Covered Parties), from any and all claims, actions, damages, liability, costs or expenses and attorney's fees which are related to, arise out of, or are in any way connected to the Parent or Legal Guardian and/or the Minor participating in activities at Gwinnett Swim, whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of a Covered Party or any other attendee or participant at Gwinnett Swim, or otherwise. (2) I Surrender and waive any rights that the Parent or Legal Guardian and/or the Minor, heirs, next of kin, family, relatives, guardians, executors, administrators, trustees and assigns may have or possess to sue or exercise any remedy or legal right to seek damages from any Covered Party for any such claims, actions, damages, liability, costs or expenses. (3) I Indemnify, hold harmless and defend each Covered Party from any and all claims, actions, damages, liability, costs, expenses and attorney fees that are related to, arise out of, or are in any way connected to the Parent/Legal Guardian and/or the Minor participating in Gwinnett Swim activities. (4) I agree to hold the organization (Gwinnett Swim), Christina Williams, any employees of Gwinnett Swim, and property owner(s) harmless from any liability resulting from the use of the premises offered for activities. I agree to be solely responsible for the care of said minor while out of the water and solely responsible for the care of any child I have brought to the pool with me. (5) I hereby give my consent/permission to Gwinnett Swim, and its representatives, as necessary in their discretion and judgment, to administer first aid and/or CPR as they deem appropriate at their discretion. In the event that my child is unconscious or I am unable to make medical decisions for my child, I authorize the Released Parties, as they deem appropriate in their sole discretion, to obtain emergency medical services and treatment for m/y/ child including, but not limited to, arranging for transportation to the nearest medical facility. I agree to abide by and be bound by any decisions as if they were made by me and will assume full financial responsibility for all medical care and/or transportation. I acknowledge that it is my responsibility to secure adequate insurance for such first aid and medical care. Any emergency medical attention and treatment in case of sickness, accident, or injury and to secure such medical attention and treatment at my sole expense and hereby agree to indemnify, hold harmless and reimburse Gwinnett Swim and/or its representatives but not limited to Christina Williams, and/or Gwinnett Swim employees, all costs and expenses that are related to, arise out of, or are in any way connected to any emergency medical attention and treatment in case of sickness, accident, or injury for said Minor. I hereby acknowledge that participating in aquatic activities could result in serious bodily injury, permanent disability or death and am fully aware of and willingly accept such risks, hazards, and dangers both individually and on behalf of said minor. I hereby certify that I am over 18 years of age and that I have carefully read and understand this entire agreement and agree to all of the above terms and conditions. Prior to signing this agreement I have had the opportunity to ask any and all questions about the lessons, participation in the program, and/or this agreement. I am aware that by signing this agreement, I assume all risks and waive and release certain substantial rights that I, my heirs, next of kin, family, relatives, guardians, executors, administrators, trustees, and assigns may have or possess, against Gwinnett Swim, and/or Christina Williams, Gwinnett Swim Employees, or any other covered party for damages/harm arising from or occurring at, during or in connection with my presence at/or participation in aquatic activities with Gwinnett Swim.
