ADDENDUM TO SW DEVELOPMENT LLC TERMS OF SERVICE

This Addendum (“Addendum”) to the TOS is required because a Master Account Holder has contracted with SW Development LLC to pay for the Service for you. All defined terms have the definition as provided for in the SW Development LLC Terms of Service. You as the Member Account Holder must agree to the terms of this Addendum in addition to the terms of the TOS and do so agree by (a) actually using the Service or (b) clicking a box that indicates you agree to the Service, where such a box is made available to you. If you do not agree to anything in the TOS or this Addendum you cannot use the Service. In the event of conflicting terms of this Addendum with the terms of the TOS, the terms of this Addendum control.

“Master Account Holder” is hereinafter defined as the Company who has contracted with SW Development LLC to pay for and provide the Service for use by you.

Access to Your Account by Master Account Holder

You agree that the Master Account Holder may access, use, process and maintain your account information and Content for their own purposes. SW Development LLC is in no way liable for disclosure of your account information or Content to Master Account Holder. The disclosure by SW Development LLC to Master Account Holder does not hereby breach any privacy agreement or policy of SW Development LLC. Any agreement regarding use of your account information and Contact the Master Account Holder is between you and the Master Account Holder and is outside of the scope of the TOS and this Addendum and must be entered into by you and Master Account Holder.

Content

You, not the Master Account Holder, are responsible for all materials and Content you submit or make available on the Service and as such you own all right, title and interest in such materials and Content. Even if you terminate your relationship with Master Account Holder, such materials and Content shall be owned. Any agreement regarding such materials and Content that you have with Master Account Holder is between you and Master Account Holder, is outside of the scope of the TOS and this Addendum and must be entered into by you and Master Account Holder.

Payment

Notwithstanding anything to the contrary in the TOS, Master Account Holder has agreed to pay all fees and charges for your use of the Service. You shall not be required to make any payments to SW Development LLC for your use of the Service.

Termination by Master Account Holder

Master Account Holder may terminate your account and/or stop providing use of the Service to you at any time.

General

The TOS as amended by this Addendum constitute the entire agreement between you and SW Development LLC, govern your use of the Service and completely replace any prior or contemporaneous agreements between you and SW Development LLC in relation to the Service.
